The above warranty covers only defects arising under normal use and does not include damages caused by accident, malfunctions or failures resulting from misuse, abuse, neglect, alteration, usage not as per product instructions, acts of nature, or improper installation or repairs made by anyone other than CBMG or its affiliates to substitute functionally equivalent new or serviceable used parts. This Warranty does not cover bending, chipping, flaking, carbide replacement labour or shipping. If CBMG determines that the problem is covered, CBMG will authorize repair or replacement of the defective product, as deemed appropriate by CBMG’s sole discretion. CBMG shall, in no event be liable for consequential damage or contingent liability arising out of any total or partial failure to function of any article manufactured by it or of any article on or in which it is used. Failure of a user to give the notice to claim as to defect claimed under the provisions of the Warranty within one (1) year after delivery to original use, such claim shall constitute a waiver by a consumer of all claims concerning goods and articles. No express implied, or statutory warranty other than that herein set forth is made or authorized to be made by CBMG. All returned warranties will not be accepted without a return authorization number. Before shipping any product to CBMG, the customer must obtain a written Material return authorization number from CBMG and provide any proof of warranty eligibility requested by CBMG. Any product received by CBMG without a return authorization may, at the CBMG option, be returned to the customer collect. Once a return authorization is obtained, the customer is responsible for packing and shipping the product/component to which its warranty claim relates to a service facility designated by CBMG within thirty (30) days after receipt of the return authorization number. Failure to return the article, at CBMG discretion, be grounds for termination of the warranty and/or suspension of any future advance exchange privileges until such outstanding defective article has been returned. CBMG will provide the customer with a new, rebuilt, refurbished or alternate article of equal or improved quality, as an exchange article (or part thereof) to replace eligible defective articles (or part thereof).
